Terms of Service

These Terms govern your purchase and use of fengshui and BaZi reports from Home Genie Pte Ltd ("we", "us", "our"), operating as Zhai. They are a contract between you and us.

1. Acceptance of Terms

You accept these Terms when you place an order, submit an intake form linking your order to your personal data, or receive and use a free or paid report we deliver. If you do not accept these Terms, do not order and do not submit an intake form. If you have already paid but no longer wish to accept, contact us within 7 days and before submitting your intake form for a full refund.

2. Service area

This service is offered globally, subject to local law. We are incorporated in Singapore and contract on Singapore-law terms (see §17). We make no representation that the service complies with the specific laws of any other jurisdiction; you are responsible for ensuring your use complies with your own local law. Where mandatory consumer-protection or data-protection laws of your country of residence apply (e.g. EU/UK consumer rights, California CPRA), those mandatory protections apply regardless of the choice-of-law clause below.

All prices are in Singapore Dollars (SGD). Your card issuer converts to your local currency at checkout. Where we are GST-registered, prices include Singapore GST. We do not currently charge taxes for jurisdictions outside Singapore — you are responsible for any local consumption/use-tax on digital goods in your jurisdiction. All reports are digital products delivered as PDF via email.

4. What our reports are NOT

Our reports are for informational and reflective purposes. They are not: financial advice; medical advice; legal advice; a substitute for property valuation, structural inspection, conveyancing due diligence, or agent negotiation; therapy or psychological assessment; or guarantees of any specific outcome.

Fengshui and BaZi claims about specific events have varying levels of empirical support. Each finding in our reports is graded — [Evidence] / [Mixed] / [Traditional] — to disclose what each rests on. Most BaZi predictions sit at [Traditional] (no peer-reviewed support). You acknowledge this when you purchase.

5. Refunds

Digital reports are non-refundable once delivered, with these exceptions:

We do not refund for "I disagree with the verdict", outcomes that didn't match predictions (graded [Traditional]), or buyer's remorse after reading. Refunds outside the cases above are at our reasonable discretion. To request a refund, email jiajun@homegenie.com.sg with your order id; we respond within 7 days and process approved refunds within 14 days.

6. Your responsibilities

When you submit an intake form, you confirm that: the birth data is yours or you have the data subject's permission; the property is one in which you have a legitimate interest; your information is accurate; and you are 18 or older. Inaccurate inputs produce inaccurate reports — we are not responsible for errors caused by inaccurate data you submitted, except where we made a clear interpretation error of accurate data (§5).

7. Service availability and force majeure

We aim for high availability but don't guarantee uninterrupted service. We are not liable for delays caused by outages of third-party providers (Anthropic, our checkout provider, email provider, Cloudflare), internet/DNS failures, government action, or other events outside our reasonable control. If a force-majeure event prevents delivery for more than 7 days, you may request a full refund.

8. Intellectual property

Your data stays yours, processed under our Privacy Policy. The report is licensed to you for personal use — you may share it with your spouse, family, agent, lawyer, or contractor for the decision it covers, but may not resell it, repackage it as your own service, publish it publicly without written permission, or use it to train AI models. Our website, templates, methodology, scripts, prompts, and grading framework are ours, protected by intellectual-property law.

9. Warranties (and disclaimer)

We warrant that we will deliver the report within the stated time frame, use reasonable care and skill, not knowingly include false information, and honor §5 refunds. To the extent permitted by law, we disclaim all other warranties, including fitness for any purpose beyond informational reading or accuracy of metaphysical predictions. This does not exclude liability that cannot be excluded under applicable law.

10. Limitation of liability

To the extent permitted by law, our total aggregate liability is limited to the amount you paid for the specific report giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages — including property decisions made on the report, financial loss, family disputes, lost profits, or emotional distress. This does not limit liability for fraud, gross negligence, death or personal injury caused by our negligence, or statutory consumer rights that cannot be waived. You acknowledge fengshui and BaZi are not exact sciences and you bear final responsibility for your decisions.

11. Indemnification

You agree to indemnify us from any third-party claim arising from your submission of personal data without proper authorization, your misuse of a delivered report (e.g. resale, republication), or your breach of these Terms. This does not apply where the claim arises from our own negligence or breach.

12. Privacy

How we handle your data is detailed in our Privacy Policy. Reading and accepting it is part of accepting these Terms.

13. Modifications

We may update these Terms. Material changes will be emailed to registered customers at least 14 days before the effective date and posted on our site. Existing orders are governed by the Terms in force at the time of order.

14. Severability

If any provision is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be replaced by the closest enforceable equivalent.

15. Entire agreement

These Terms, with our Privacy Policy, constitute the entire agreement between you and us regarding the service, superseding prior representations or marketing copy.

16. Assignment

You may not assign your rights under these Terms. We may assign to a successor entity (e.g. on sale of the business), provided your data continues to be protected to at least the level set out here.

17. Governing law and dispute resolution

These Terms are governed by Singapore law. Disputes will be resolved by: (1) direct discussion for at least 30 days; (2) if unresolved, mediation at the Singapore International Mediation Centre or a mutually-agreed online dispute-resolution provider; (3) if still unresolved, the Singapore courts have non-exclusive jurisdiction — a consumer whose local law gives them a mandatory right to sue locally retains that right.

These Terms are written in plain English as a starting point. They have not yet been reviewed by a qualified lawyer for every jurisdiction in which we market or accept customers. We are finalising that review.
